Petitioner who is in custody seeks bail in a case registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 25(1-b)a/27 of the Arms Act.
Informant who is father of deceased Ranjit Mandal had alleged in his fardbeyan that on 20.06.2018 at about 11:00 am his son had gone to collect his dues and was returning home at 11:45 am when four FIR named accused including petitioner came armed with pistol and Vikas Kumar (petitioner) and
Patna High Court CR. MISC. No.1387 of 2019(4) dt.29-03-2019 2/2 Deepak Kumar fired upon him as a result of which he fell down and died. Four accused started to flee away, however, Vikas Verma (petitioner) was apprehended with help of public and from his possession one loaded pistol and one loaded country made gun was recovered and were handed over to the police. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 21.06.2018.
Considering the fact that there is direct allegation of firing upon the petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.
