JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 5.2.2016 for the offences punishable under Sections 341, 323, 307, 504, 506, 324/34 of the Indian Penal Code and Section 27 of the Arms Act. Altogether four injuries were found on the person of informant Pramod Kumar Singh whereas injured Subodh Kumar Singh sustained only one injury and injured Ranbir Kumar Singh sustained altogether four injuries. The allegation against this petitioner is that he assaulted the informant by means of Bamboo, causing injury on his head. So far as rest of the injured are concerned, it is alleged that they were assaulted by the petitioner and other co-accused.

No.29677 of 2016 (2) dt.27-07-2016 2/2 Learned counsel for the petitioner points out that coaccused Santosh Kumar Singh, having more or less similar allegations, has already been granted privilege of bail. No doubt, informant sustained one grievous injury on his head but the concerned Doctor opined regarding the nature of aforesaid injury only on the basis of profuse bleeding and came to conclusion that the said injury was dangerous to the life of the informant. So far as injured Ranbir Kumar is concerned, even after a lapse of six months after his examination, the complete injury report could not be brought on record.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria, in connection with Choutham P.S. Case No. 79 of 2015.
