JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Maner P.S. Case No. 548 of 2018, registered for the offences punishable under Sections 341, 323,326, 307, 313/34 of the Indian Penal Code.
Allegation against the petitioners is that they set ablaze the daughter of the informant by fire causing injury to her.
Submission of the learned counsel for the petitioners that there is general and omnibus allegation against the petitioners and statement of victim girl was not recorded by the police. Petitioner no. 4 is a lady.
Learned A.P.P. for the State has opposed the prayer of
Patna High Court CR. MISC. No.22996 of 2019(5) dt.03-09-2019 2/2 bail on the ground that injury report disclosed that victim has received 45 per cent burn injury.
Having heard both sides. So far as petitioners no.1 to3 are concerned, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to them, however, they are directed to surrender before the learned Court below and make prayer for regular bail and Court below will consider the matter on its own merit without being prejudiced by order of this court. So far as petitioner No.4 is concerned, considering the fact that she is lady, let the petitioner No.4 above named, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate, 1st class, Danapur in connection with Maner P.S. Case No. 548 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
