The petitioners are apprehending their arrest in connection with Tandwa P.S. Case No. 19 of 2017 for the offences instituted under Sections 366(A)/34 of the Indian Penal Code.
It is alleged that one Afroj Mian has abducted the daughter of the informant while she went to the school with the help of other co-accused persons.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The statement of the victim girl has been recorded
Patna High Court Cr.Misc. No.28604 of 2017 (2) dt.07-07-2017 2/2 under Section 164 of the Cr.P.C. There is no allegation of physical or sexual abuse alleged against her. She has not supported the allegations made in the F.I.R.
On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Tandwa P.S. Case No. 19 of 2017 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
