====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Bachhwara P.S. Case No. 143 of 2022 dated 17.06.2022 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 427, 307, 332, 353, 431, 504 of the I.P.C. and Section 8(B) of the National Highways Act, 1956.

3. As per the prosecution case, during protest of 'Agneepath Scheme', 31 named and 100-150 unknown persons, allegedly, assembled and obstructed road traffic, burnt tyres, and damaged the vehicles etc.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.23273 of 2025(2) dt.04-07-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioner. There is no specific allegation against the petitioner. The petitioner is a student of B.A. Part-III Course and he is pursuing his study at APSM College, Barauni. It is further submitted that on the alleged date and time of occurrence, he was present in his class at APSM College, Barauni and due to blockage of road, he did not return his house. The petitioner has no concern with the alleged offence. It is further submitted that other co-accused persons, Prince Kumar, Duja Kumar @ Aniket Kumar and Ramtanay Kumar have already been granted anticipatory bail by a Bench of this Court in Cr. Misc. No. 73552 of 2023 vide order dated 29.11.2023, annexed as Annexure-2 to the present bail petition. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.23273 of 2025(2) dt.04-07-2025 3/3 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bachhwara P.S. Case No. 143 of 2022, subject to the condition as laid down under Section 482(2) of the B.N.S.S, 2023.

7. The application stands allowed.
