JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 147, 148, 337, 338, 307, 395, 427, 504, 506, 120B of the Indian Penal Code and 27, 25(1-b)a, 26, 35 of the Arms Act.

Allegation in brief is that police reached at the spot as there was some dispute between the management and labourers of NPGC/NTPC and police apprehended one person at the spot so villagers became furious and started pelleting stones over the police party and on the basis of video footage 29 persons were identified and the case was lodged.

Learned counsel appearing on behalf of the petitioner submits that there is no specific allegation against the petitioner

Patna High Court Cr.Misc. No.28936 of 2017 (2) dt.01-07-2017 2/2 and similarly situated other co-accused have been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No.46563 of 2016 and this petitioner has no criminal antecedent.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Jai Ram Paswan be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Narari Khurd Kala P.S. Case No.16 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
