JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 Petitioner apprehends his arrest in connection with Gaya Rail (GRPS) P.S.Case No. 324 of 2018 registered under Sections 147, 323, 341, 307, 504, 506, 353, 290/34 of the Indian Penal Code and Section 37(c) of Bihar Excise Act, including Sections 137, 145 and 146 of the Railway Act. Allegation as per FIR is that when police patrolling party tried to apprehend one person, who was in drunken condition, they were assaulted and petitioner is named in the FIR. There is also allegation against the petitioner that he provoked the passengers against the police party. Submission of learned counsel for the petitioner is that there is no specific allegation against him and he has no criminal antecedent.

No.1155 of 2019(2) dt.17-01-2019 2/2 Having heard both sides and in the facts and circums4tances, let petitioner surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
