The petitioner apprehends his arrest in a case under Sections 306 and 109 of the Indian Penal Code. Shiv Narayan Mandal, the father-in-law of deceased Sanjay Verma, disclosed that he married his daughter Neha Verma with Sanjay Verma, the deceased. The petitioner took Neha Verma and Sanjay Verma to Delhi for providing job but the petitioner eloped with Neha Verma. Neha Verma also filed a case under Section 498A and other sections of the Indian Penal Code against Sanjay Verma. Neha Verma filed a divorce course against her husband Sanjay Verma for dissolution of marriage. It is alleged that on account of such, Sanjay Verma committed suicide. The police, after investigation, submitted charge sheet against Neha Verma but the investigation is kept pending against the petitioner.

No.37297 of 2014 (3) dt.19-05-2015 2/2 The investigating officer has not collected any evidence to show that the petitioner ever instigated or abetted Sanjay Verma to commit suicide. Neha Verma herself filed the divorce case as she was not willing to live with her husband and, on such, Sanjay Verma committed suicide.

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Munger Kotwali P.S. Case No. 130/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
