JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. Petitioners apprehend their arrest in connection with Complaint Case No. 807C of 2013 registered for the offence under Sections-406, 420/34 of the Indian Penal Code. The accusation against the petitioners is that they got transferred some lands in their names whereas; they utilized the money of trust for purchasing the aforesaid lands. The contention on behalf of the petitioners is that

No.49739 of 2014 (3) dt.19-05-2015 2/2 according to complaint case, the valuation of the land was of Rs more than 8,00,000/- (eight lacs) and only Rs 2,00,000/- (two lacs) and odd is said to have been withdrawn from the account of the concerned school and moreover, at paragraph-13 of the petition, it has, specifically, been pleaded that the aforesaid amount was utilized by the petitioners for making purchase of articles for the concerned school.

Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 807C of 2013 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Nalanda at Bihar Sharif.

The original case record of Complaint Case No. 807C of 2013 be returned to the concerned court without any delay.
