JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Chhatapur P.S.Case No. 239 of 2014 instituted under Sections 409 and 420 of the Indian Penal Code. The allegation against the petitioner is that he committed irregularities in disbursement of amount and deposited only Rs. 5,39,400/- in Anchal Account out of Rs. 9,33,832/-. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. The petitioner has been made accused due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs. 1,50,000/- (one lac fifty thousand only) in the court below, which shall be subject to final disposal of the case.

Patna High Court Cr.Misc. No.49492 of 2015 (3) dt.08-02-2016 2/2 On behalf of the State it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs. 1,50,000/- (one lac and fifty thousand only) in the court below, which shall be subject to final disposal of the case.

Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Supaul in connection with Chhatapur P.S.Cse No. 239 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
