The petitioners apprehend their arrest in Lalganj P.S. case No. 58 of 2017 under Section 307, 379 and other Sections of the Indian Penal Code.
The informant alleged that while he was returning from his shop on a motor cycle and reached near Masjid chowk Md. Ashgar and his sons surrounded him and on the order of Md. Ashgar his three sons, Md. Haidar, Md. Sabdar and Md. Manjar assaulted him with fists and slaps. Md. Sabdar assaulted him with butt of pistol of his eye and also stanched Rs. 20,000/- from his possession.
Patna High Court Cr.Misc. No.29186 of 2017 (3) dt.19-08-2017 2/2 The learned counsel for the petitioners submits that prior to lodging of this case Md. Haidar Ali, petitioner No.3, lodged Lalganj P.S. case No. 57 of 2017 alleging that the accused persons came to his shop and assaulted the informant and took away money from the chest. It is submitted that thereafter this false case has been lodged. The injuries are simple in nature. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. case No. 58 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
