Petitioner apprehends his arrest in Tekari P.S. Case No.375 of 2017, registered under Sections 30(a), (c) (d) of the Bihar Prohibition and Excise Act, 2016.

The S.H.O. of Panchanpur O.P. named the petitioner along with other accused persons and alleged that they were preparing country made liquor and on such raid was conducted. 10 litres of country made liquor made of Mahua and other articles used in preparing liquor were recovered. Learned counsel for the petitioner submits that the recovery was made from the place situated outside the village. Petitioner has got no criminal antecedent. Arvind Yadav, similarly situated co-accused, has already been granted anticipatory bail vide Cr. Misc. No.162 of 2018. The case of the

Patna High Court CR. MISC. No.22259 of 2019(2) dt.11-04-2019 2/2 petitioner stands on the same footing.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Tekari P.S. Case No.375 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
