Petitioner is apprehending arrest in connection with Bettiah Mufassil P.S. Case No. 213 of 2019 for the offence under sections 420, 406, 384, 506 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Allegation against this petitioner is that the petitioner has borrowed Rs. 2 lacs from the informant but he has not returned the money and he is threatening the informant. Learned counsel submits that in fact petitioner himself has given loan of Rs. 2 lacs to the informant and on demand he

Patna High Court CR. MISC. No.22523 of 2020(2) dt.04-09-2020 2/2 returned only one lakh through net banking and in order to avoid payment of balance 1 lakh, the present case has been filed.

Considering the genesis of this case between the parties, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Bettiah Muffasil P.S. Case No. 213 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
