The petitioner apprehends her arrest in Kurtha P.S. Case No. 203/2016, registered for the offences punishable under Sections 419, 420 and other sections of the Indian Penal Code. One Rahul Vishwakarma was appointed as panchayat teacher in Primary School Deva Bigha falling in gram panchayat Khatangi and the person of same name was also appointed as panchayat teacher in Primary School Alawalpur falling in gram panchayat Kodamarai. It is alleged that Panchayat Secretary and Mukhiya have fraudulently appointed Rahul Vishwakarma, as panchayat teacher of two gram panchayats.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.28802 of 2017 (3) dt.21-07-2017 2/2 petitioner is Mukhiya of gram panchayat Kodamarai. The verification of certificates of educational qualification was entrusted to Block Education Officer and petitioner is not at all responsible for verification of the certificates. Considering the facts aforesaid and the fact that petitioner is a lady, the petitioner above-named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 203/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
