Heard Ms. Kumari Sujata Sinha, learned counsel for the petitioner and Mr. Ajay Kumar learned counsel for the State. The petitioner seeks bail in connection with Nagar P.S. Case No. 1088 of 2019 instituted for the offences under Sections 30(a), 36, 38 and 41 of Bihar Prohibition and Excise Act, 2016.

It appears from the First Information Report that approximately 441.870 litres of liquor was recovered from a newly constructed house stated to be of the petitioner. Learned counsel for the petitioner has submitted that the house from where recovery has been made is not inhabited by the petitioner or his family members and is accessible to all persons. He has falsely been made accused in this case. The petitioner is stated to be a person of clean antecedent and is in custody since 16.03.2020.

Regard being had to the aforesaid facts, the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Nagar P.S. Case No. 1088 of 2019.
