2. The petitioner apprehends his arrest in connection with Nagarnausa P.S. Case No. 62 of 2023 registered under Sections 406, 420, 504, 506 and 34 of the Indian Penal Code.
3. The prosecution story, in brief, is that petitioner entered into agreement of sale and took Rs. 31 lakhs in advance but thereafter refused to register the sale deed or return the amount.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that one day before lodging of this present case, mother of the informant has also lodged the case bearing Laheri P.S. Case No. 272 of 2023 having similar allegation against the petitioner and only to
Patna High Court CR. MISC. No.28155 of 2024(2) dt.14-05-2024 2/2 mount pressure, which shows the falsity of the present case. Petitioner is a government employee and the on the alleged day of occurrence, she was on duty. The petitioner has not received any money from the informant. The alleged amount in question was transferred to the account of the husband of the petitioner due to which he is already under custody. The dispute between the parties is purely civil in nature.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Nagarnausa P.S. Case No. 62 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
