The petitioner apprehends his arrest in a criminal prosecution registered under Sections 307, 354(A), 324, 379 and some other allied offences under the Indian Penal Code. Taking into consideration the fact that the petitioner along with other accused persons participated in assault to the informant as a result of which he sustained as many as six injuries on his person, out of which two have been opined to be grievous in nature, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Jhajha P.S.Case 146 of 2014 pending in the court of the learned Sub Divisional Judicial Magistrate, Jamui is rejected. However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered and decided on its own merits without being prejudiced by the present order.
