2. Petitioner seeks regular bail in connection with Amnaur P. S. Case No. 175/2023 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, this petitioner along with other F.I.R. named accused persons assaulted the husband of the informant by means of knife as a result of which he sustained injury.

4. Learned counsel for the petitioner submits that specific allegation of assault with knife is against co-accused Bablu Sah. There is no allegation of specific overt act against the petitioner and he is only alleged to be the order giver. He

Patna High Court CR. MISC. No.26030 of 2024(2) dt.10-04-2024 2/2 next submits that chargesheet has already been submitted. Petitioner claims clean antecedent and he is in custody since 19.01.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the nature of accusation, period of custody and the fact that chargesheet has been submitted, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Amnaur P.
