JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 341,323,324,354/34 of the Indian Penal Code and section 3(i) (x) of the Scheduled Caste and Scheduled Tribe ( Prevention of Atrocities) Act.

Learned counsel for the petitioners submits that no offence under Section 3(i) (x) of the Scheduled Caste and Scheduled Tribe ( Prevention of Atrocities) Act is made out on the

Patna High Court Cr.Misc. No.51482 of 2014 (2) dt.19-05-2015 basis of the allegation made in the First Information Report. He appears to be correct in his submission. He has also submitted that though there is allegation of assault by these petitioners but such allegation is vague and not specific.

In view of the submissions as above, let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ajay Kumar, learned Judicial Magistrate, Bettiah, West champaran in Bairiya P.S.
