JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-08-2017 Heard the learned counsel for the petitioners, the learned counsel for the informant and the learned A.P.P. The petitioners apprehend their arrest in Bidupur P.S. case No. 54 of 2017 under Section 307, 379, 386 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that petitioners demanded extortion of Rs. 50,000/- and due to non payment of the same the petitioners assaulted the informant with iron rod on different parts of his body and fled away after snatching golden chain and motor cycle.

Patna High Court Cr.Misc. No.29199 of 2017 (3) dt.21-08-2017 2/2 The learned counsel for the petitioners submits that all the allegations are false and concocted. The petitioners have falsely been implicated in the case.

On the other hand the learned counsel for the informant as well as the learned Additional Public Prosecutor opposed the prayer for anticipatory bail.

It appears that petitioners are alleged to have assaulted the informant due to non payment of extortion amount. The informant got as many as three injuries on his leg and other parts of his body. The petitioner No.1 has also got criminal antecedent.

Considering the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
