The petitioners who are in custody since 26.02.2019 have filed this application for grant of bail in connection with Gopalpur (Rangra) P.S. Case No. 384 of 2018 registered for the offence under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

As per the allegation in the F.I.R., eleven named accused persons including the two petitioners herein assaulted the husband of the informant. It is further alleged that the petitioner no.1 Devendra Singh fired on the informant's husband causing injury on his chest as a result of which he fell down. He later died in the hospital.

No.25553 of 2019(4) dt.31-07-2019 2/2 Having heard the submissions on behalf of the petitioners as also on behalf of learned A.P.P. for the State, taking into consideration that there is direct allegation of firing on petitioner no.1, Devendra Singh, the Court is not inclined to enlarge the petitioner no. 1 on bail and, as such, his application for bail is rejected.

Further having heard learned counsel for the parties and taking into consideration the facts and circumstance of the case including the fact that other similarly situated co-accused have been enlarged on bail vide order dated 14.02.2019 passed in Criminal Misc. No. 8671 of 2019, the Court is inclined to enlarge the petitioner no.2 Ravi Kumar @ Ravi Singh, on bail. Let the petitioner no.2 be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge, Naugachia in Gopalpur (Rangra) P.S. Case No. 384 of 2018.
