Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Chewara P.S. Case No. 19 of 2016 for the offence punishable under Sections 498-A, 326-A, 307/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act. However, the cognizance has been taken under Sections 304-B, 498-A, 302/34 of the Indian Penal Code.

After completion of investigation, the police had exonerated the petitioners and submitted the final form in the case but the learned Magistrate took cognizance after differing

Patna High Court CR. MISC. No.32568 of 2021(3) dt.04-03-2022 2/2 with the final form. The petitioners are mother-in-law of the deceased, who are 75 and 65 years old respectively. Considering the aforesaid facts, this bail application is allowed.

Let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sheikhpura, in connection with Chewara P.S. Case No. 19 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
