The petitioner seeks bail in Raj Nagar P.S. Case No. 277/2017, instituted for offence under Section(s) 302/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is lady.

It is alleged in the written report that nephew of informant Santosh Rai was working in Delhi. He had come at his village in Chhath festival. It is further alleged that earlier Santosh Rai had worked under supervision of Mahesh Mandal and his payment was due. On the date of occurrence deceased Santosh Rai had gone to Mahesh Mandal for demanding his dues. Thereafter, he returned to the informant and stated that

Patna High Court Cr.Misc. No.77535 of 2018(2) dt.15-01-2019 2/2 accused Mahesh Mandal and his wife Ghambhira Devi had brutally assaulted him and caused injuries after putting him under water. After sometime, Santosh Rai became senseless and doctor declared him dead.

Learned counsel for the petitioner has submitted that vague allegation has been levelled against this petitioner. From the written report it appears that deceased had gone to make demand of dues from Mahesh Mandal, who is husband of this petitioner.

Petitioner has clean antecedent. She is in custody since 18.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani in connection with Raj Nagar P.S. Case No. 277/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
