Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of eight weeks.

The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 225, 353 and 186/34 of the Indian Penal Code.

The prosecution allegation, in short, is that the accused persons attacked on the police party and got released one of the co-accused.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to

Patna High Court CR. MISC. No.32585 of 2021(2) dt.21-12-2021 2/2 mistake of fact. There was a protest against the police. It is alleged that the petitioner managed to flee away. The petitioner submits that on the alleged date, he was not present at the place of occurrence, hence the involvement of the petitioner does not arise.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Nagar Sahayak P.S. Case No. 754 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
