The petitioners apprehend arrest in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act. Father of the deceased made allegation that her daughter was married to Sanjeet Jha about ten years ago. Sanjeet Jha was killed by his father and other family members. It is alleged that father-in-law, mother-in-law, brother-in-law and sister-in-law of the deceased killed his daughter. It is submitted that the petitioners are brother-inlaw and sister-in-law of the deceased. They have no manner of concern with the family affairs of the deceased. The informant
Patna High Court Cr.Misc. No.50101 of 2015 (3) dt.14-12-2015 and his brother in paragraphs 6 and 7 of the case diary made very specific allegation against Golaknath Jha and his wife about killing of the deceased.
Considering the fact that no specific allegation is made against the petitioners, who are brother-in-law and sister-inlaw of the deceased, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani (Bathnaha) P.S. Case No. 69 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
