Learned counsel for the petitioner undertakes to remove the defects within two weeks.

In view of the undertaking given by the petitioner, the matter is taken up for consideration.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Beldour P.S. Case No.132 of 2014 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. His prayer for bail was earlier rejected by this Court vide order dated 04.12.2019.

Patna High Court CR. MISC. No.32757 of 2021(2) dt.13-04-2022 2/3 The petitioner is alleged to be a conspirator in a case under Section 302 of the Indian Penal Code relating to murder of grandfather of the informant.

It is contended by the learned counsel for the petitioner that in the instant case, all the ten named accused persons including the assailants, as per the FIR, have been granted bail by different Benches of this Court. He has drawn my attention towards the orders annexed to the present application as Annexure-3 and Annexure-4 series. Learned counsel for the State opposed the prayer for bail. However, he does not dispute the submission made on behalf of the petitioner that other accused persons including the assailants have already been granted bail by different orders passed by this Court.

Considering the period of over three years undergone by the petitioner in custody as an under-trial prisoner as also the fact that the other co-accused persons have been granted bail vide orders as contained in Annexure-3 and Annexure-4 series to the present application, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VI, Khagaria in connection
