JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Mahila P.S. Case No. 115 of 2018 for the offenses under Sections 498A, 34 IPC and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel appearing on behalf of the informant submits that the informant is ready to stay with the husband. Learned counsel for the petitioner submits that the petitioner is not ready to keep the wife having regard to the bitterness that developed on account of his arrest and custody in the instant case and the relationship is at the last stage of no return. Divorce case is pending.
Considering the totality of the fact situation, let the petitioner, above named, be enlarged on bail on furnishing bail
Patna High Court Cr.Misc. No.80506 of 2018(2) dt.15-01-2019 2/2 bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Smt. Priya Shekhar Judicial Magistrate 1st Class, Patna in connection with Mahila P.S. Case No. 115 of 2018 on the condition of payment of Rs. 5,000/- (five thousand) per month as alimony to the informant subject to the final outcome of the divorce case. Failure on the part of the petitioner in making payment of Rs. 5,000/- per month to the informant will lead to cancellation of his bail bonds. The monthly payment of Rs. 5000/- alimony will begin from February, 2019.
