JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 399, 402, 341, 414 of the Indian Penal Code and 25 (1-B)a/26/35 of the Arms Act. Allegation against the petitioner along with other accused persons is of planning for committing crime and there is recovery of country made pistol, motorcycles and mobile phones.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.01.2020 and was arrested from the spot with other co-accused persons on raid by the police. There is no recovery from the conscious possession of the petitioner. The similarly situated co-accused have been granted

Patna High Court CR. MISC. No.24505 of 2020(3) dt.02-11-2020 2/2 bail by the Co-ordinate Benches of this Court vide order dated 31.08.2020 passed in Cr. Misc. No. 20506/2020 and vide order dated 19.06.2020 passed in Cr. Misc. No. 19891/2020. Learned APP for the State opposes the prayer for bail petition.

In the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each in connection with Bidupur P.S. Case No. 11/2020 to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
