JUSTICE SUDHIR SINGH ORAL ORDER 20-05-2015 The petitioner is apprehending his arrest in connection with Paliganj P.S. Case No. 290 of 2013 for the offences instituted under Sections 384, 436 and 504/34 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that before the alleged occurrence, the petitioner Kallu Kumar had demanded ransom from the informant. Later on, co-accused Sonu Kumar alongwith one unknown person came to the wine shop of the informant and asked for wine which was not provided by the informant because the shop was closed on official closing day. Thereafter, in the night co-accused Sonu Kumar and others came and committed arson in the wine shop.

Further it has been submitted that from perusal of the F.I.R., it appears that no specific allegation has been alleged in the F.I.R. i.e., against the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. but no specific allegation against the petitioner has been made regarding his participation in the said occurrence.

Considering the aforesaid facts and circumstances, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Paliganj P.S. Case No. 290 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
