Petitioners seek bail in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 235 of 2019 registered for the offence under Sections 302, 307 and 34 of the Indian Penal Code pending in the Court of 6th Additional District and Sessions Judge, Bhagalpur.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to family dispute. Further submission is that petitioners

Patna High Court CR. MISC. No.22086 of 2020(2) dt.21-09-2020 2/2 are languishing in jail custody since 22.01.2020 and 10.01.2020 respectively and they have no criminal antecedent. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners by contending that petitioners are named in the first information report and there is specific allegation against them in the first information report. Hence, this is not a fit case for bail.
