Heard Mr. Rajive Ranjan Singh, learned counsel for the petitioner and Mr. Anitesh Kumar, learned counsel for the State. The petitioner seeks bail in connection with Parbatta P.S. Case No. 14 of 2020 dated 13.03.2020 instituted for the offences under Sections 30(a)/38(i) of the Bihar Prohibition and Excise Act, 2016.

From the First Information Report, it appears that there is recovery of 446 litres of liquor from the house of the petitioner.

It has been submitted on behalf of the petitioner that recovery has falsely been shown from the house of the petitioner. The seizure list appeared to have been made, it has been argued, without complying the provisions contained in Section 100 of the Code of Criminal Procedure. It has also been submitted that petitioner has no criminal antecedent and he is in custody since 26.02.2020.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge (Excise Act), Bhagalpur in connection with Parbatta P.S.
