Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Khagaria P.S. Case No. 1021 of 2022 registered for the offence under Section 307 of the Indian Penal Code and 27 of the Arms Act. F.I.R. in short is that informant had gone out for his personal work, when he was coming back to his house, on the way petitioner accused Suraj Rajak and four other named persons abused there and made indiscriminating firing at the informant and two bullet hit on the left arm of the informant and he fell down and two persons who were with the informant hide

Patna High Court CR. MISC. No.24079 of 2023(2) dt.18-05-2023 2/2 themselves after hearing the sound of firing, after that they brought to the informant to the Sadar Hospital, Khagaria for treatment.

Learned counsel for the petitioner submits that the petitioner has committed no offence and it is the Rupesh Kumar @ Tiger who has assaulted the victim.

Learned counsel for the petitioner also submits that the petitioner is in custody since 21.01.2023. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 1021 of 2022.
