2. The petitioner is apprehending arrest in connection with Sultanganj P.S. Case No. 277/2024 registered on 12.06.2024 for the offenses punishable under Sections 304B/34 of the Indian Penal Code.
3. As per the prosecution, the allegation is that the informant's sister was killed by her in-laws' family by administering poison, and the incident occurred within six years of her marriage.
4. Learned counsel for the petitioner submits that the petitioner, being the husband of the deceased, is innocent and has not committed any offence. It is further submitted that the allegations mentioned in the F.I.R. are general and omnibus in nature, with no specific attribution of any overt act to the
Patna High Court CR. MISC. No.27258 of 2025(2) dt.07-05-2025 2/2 petitioner. It is also argued that there had been no complaint against the petitioner after the marriage, and the current allegations have been maliciously levelled. Moreover, the exact cause of death is yet to be determined, as the final opinion is pending the report of chemical analysis from the Forensic Science Laboratory (F.S.L.).

On the other hand, learned A.P.P. for the State strongly opposes the prayer for bail and submits that since the death occurred within six years of marriage, a presumption arises under the relevant provisions of law. Hence, the crux of the allegation directly implicates the petitioner, being the husband of the deceased.
6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Sultanganj P.S. Case No. 277/2024, pending before the learned ACJM, Bhagalpur, is hereby rejected.
