JUSTICE SUDHIR SINGH ORAL ORDER 04-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Rivilganj P.S.Case no. 35 of 2015 arising out of Complaint Case No. 3346 of 2014 instituted under Sections 147, 148, 323, 324, 307 and 380 of the Indian Penal Code. The allegation against petitioners is that they assaulted the informant and his wife with dab and lathi. It is submitted on behalf of the petitioner that the petitioners have got no criminal antecedent. From perusal of the complaint petition, which was later on instituted under Section 156(3) Cr.P.C., it appears that the alleged occurrence is said to have taken place on 11.10.2014 but the said complaint case was

Patna High Court Cr.Misc. No.48743 of 2015 (3) dt.04-02-2016 2/2 filed in the court below on 20.11.2014. No explanation in respect to delay has been made by the prosecution. From perusal of paras 16 and 17 of the case diary it is evident that the alleged occurrence is said to have taken place for a petty reason. On behalf of the State, it is submitted that the petitioners are named in the complaint case.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Rivilganj P.S.case No. 35 of 2015 arising out of Complaint Case No. 3346 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
