The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

As per the prosecution case, on secret information informant along with police party raided the house of petitioner and found a person unloading the iron plates, Oxygen gas cylinders, Gas cutter etc. from a pickup van bearing Registration No. BR-28G/4684. On seeing the police party the said person fled away and the Chowkidar disclosed the name of person as petitioner.

It is submitted that petitioner has been falsely

Patna High Court CR. MISC. No.23365 of 2023(2) dt.26-06-2023 2/2 implicated in this case. Recovery has been made from open place in front of the house of petitioner. Nothing has been recovered from conscious possession of this petitioner. Petitioner is aged about 60 years old and has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 182 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
