2. The petitioner seeks bail in connection with NDPS Reg No. 50 of 2023 arising out of Mohania P.S. Case No. 372 of 2023 registered for the offence under Sections 8(c), 21(b) and 29 of the NDPS Act.

3. As per the prosecution case, the recovery is of 48.950 grams of Heroine.

4. The petitioner is in jail since 7.6.2023.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is in custody since 2023 and the trial of the petitioner is delayed by the prosecution.

6. Considering the facts of the case and also considering the custody of the petitioner, this application is

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I-cumSpecial Judge, Kaimur at Bhabhua/concerned Court below in connection with N.D.P.S. Reg. No. 50 of 2023 arising out of Mohania P.S. Case No. 372 of 2023, subject to the condition that the bailors should be close relative of the petitioner.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Mohaniya Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

9. As a condition of this order, the petitioner is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial on the dates fixed in the trial. (Sandeep Kumar, J) Vikas/- U
