This is an application for grant of regular bail filed on behalf of the petitioners. Petitioners are in custody in connection with Masaurhi PS Case No. 748 of 2018 for the alleged offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
In the instant case, total 440 kgs. of Mahua flower was seized. Learned counsel for the petitioners submits that mahua flower is used as fodder. There is no material to indicate that the seized flower was aggregated for the purpose of manufacturing mahua liquor. Petitioners are in custody since 15.10.2018. Considering the fact that petitioners have no criminal antecedent and they are in custody since 15.10.2018, this application is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Masaurhi PS Case No. 748 of 2018.
