JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Masaurhi P.S. Case No. 14 of 2016 registered for the offence punishable under sections 307, 354, 379 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing specific has been alleged against this petitioner in the first information report. Specific allegation is against co-accused Dilip Pandey. The present informant is close associate of the Mukhiya of the Panchayat and this petitioner is a Member of the Panchayat Samittee. Petitioner on receiving several complaints from the villagers had raised voice against the Mukhiya and in revenge the present false case has been lodged implicating this

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No. 14 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
