2. In this case, the petitioner is seeking regular bail in connection with Simari Bakhtiyarpur P.S. Case No. 368 of 2023 (S. Tr. No. 19 of 2024), registered for the offences punishable under Sections 376, 384, 504, 506, 509/34, 354(C) of the Indian Penal Code.

3. As per allegation, the petitioner established physical relationship with the victim at the pretext of marriage. Over course of time, the victim got employment in Bandhan Bank. The petitioner, taking the victim into the false confidence, used to cheat her salary as well. When the victim made pressure upon

Patna High Court CR. MISC. No.25668 of 2024(4) dt.10-09-2024 2/3 him to solemnize marriage, he demanded Rs. 5,00,000/-. He also threatened her to ruin her life by making the video clips of their private moments viral.

4. Learned counsel for the petitioner submits that when the victim admits the marriage which was solemnized in a temple and the status of the victim is that she is legally wedded wife of the petitioner, this case prima facie appears to be false.

5. On the other hand, the learned counsel for the informant submits that in the same F.I.R. in subsequent portion, it has been mentioned that the petitioner made evasions when she requested for marriage. He also threatened her to make the video viral.

6. The stage of the trial was called for from the court below which is available with the record, which shows that three witnesses were examined till the date of transmission of report to this court i.e. 2nd August, 2024.

7. Learned counsel for the informant has submitted that 4th witness has also been examined and only one witness i.e. Investigating Officer has remained to be examined and the trial is on its verge of conclusion.

8. Learned counsel for the informant undertakes that except the Investigating Officer, no witness shall be examined.

9. Considering the above mentioned facts and circumstances, the learned court below is directed to conclude the trial within three months.

10. With the aforesaid observation, this application is dismissed.
