The petitioner apprehends his arrest in a case registered for the offence under Sections 447, 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

It is alleged that all the accused persons including this petitioner armed with lathi, danda, Garasi and spade attacked the informant and inflicted injuries on his persons including head.

It is submitted on behalf of petitioner that present case is outcome of land dispute between the parties. Both parties are gotiyas. As a matter of fact, it was the informant party, who assaulted the petitioner, for which, complaint case no. 28 of 2023 was lodged. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.23572 of 2023(2) dt.27-06-2023 2/2 Considering the nature of dispute and clean antecedent of petitioner, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Mohania, Kaimur (Bhabua) in connection with Mohania P.S. Case No. 36 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
