NILU AGRAWAL ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Petitioner seeks bail in connection with Excise Case No. 346 of 2019 arising out of Jagdishpur P.S. Case No. 43 of 2019 for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the police personnel is that on secret information, they reached Ramdas Tola and found the petitioner trying to flee away with a bag. The petitioner was apprehended and on search from the bag, 25 litres of Mahua wine was recovered. Accordingly, a seizure list was prepared.

It has been submitted by the learned counsel for the

Patna High Court CR. MISC. No.24092 of 2019(2) dt.18-04-2019 2/2 petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that he is languishing in judicial custody since 23.02.2019 and has been punished enough.

However, learned APP for the State opposes the prayer for bail.

Considering the nature of allegations and that the petitioner does not bear any criminal antecedent as stated in para 3 of the present application, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, 4th-cum- Special Judge, Excise Act, Bhojpur at Ara in connection with Excise Case No. 346 of 2019 arising out of Jagdishpur P.S. Case No. 43 of 2019.
