This application for regular bail arises out of Bhagwan Bazar P.S. Case No. 26 of 2020, disclosing offences punishable under Sections 414 and 34 of the Indian Penal Code. The petitioner is in custody since 11.01.2020. Referring to the petitioner's criminal antecedent, learned counsel for the petitioner has submitted that because of the petitioner's implication in one of the cases, he is being named in other cases also by the police indiscriminately. He has submitted that, as per the case of the prosecution, a motorcycle and two cellular phones were recovered from the petitioner's possession by the police but there is nothing to show that the said articles were stolen properties, so as to constitute an offence under

Patna High Court CR. MISC. No.21251 of 2020(2) dt.30-06-2020 2/2 Section 414 of the Indian Penal Code.

Considering the above and the petitioner's custody since 11.01.2020, this application is allowed. Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saran at Chhapra in connection with Bhagwan Bazar P.S. Case No. 26 of 2020.
