JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Shikarpur P.S. Case No. 26 of 2020 for the offence under Section 366A of the Indian Penal Code.

The allegation against the petitioner is that he is involved in abduction of the daughter of the informant. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 30.01.2020. The statement of the victim recorded under Section 164 of the Cr.P.C discloses that she is major and on her own sweet-will, she went to Gorakhpur and stayed with the petitioner.

No.24764 of 2020(3) dt.05-02-2021 2/2 Considering the statement of the victim recorded under Section 144 of the Cr.P.C., the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 26 of 2020.
