The petitioner seeks bail in connection with Hayaghat P.S. Case No. 212 of 2025 instituted for the offence under Sections 137(2) of the Bharatiya Nyaya Sanhita, 2023. Subsequently, Sections 238, 140, 103 & 3(5) of the BNS were added.

The prosecution case, in short, is that the informant's brother, who had gone to sleep at a poultry farm on 14.11.2025 as part of his routine, went missing and did not return home the next morning. Despite searching at the poultry farm, contacting him on his mobile phones, and making inquiries with relatives, his whereabouts could not be traced,

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.11.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused, namely, Nirmala Devi. There is no specific allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Charge sheet has already been submitted in this case. Other co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 07.05.2026, passed in Cr. Misc. No. 23125 of 2026. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, claim based on parity and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.28598 of 2026(5) dt.22-07-2026 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Hayaghat P.S. Case No. 212 of 2025.
