The petitioner has renewed the prayer for bail in a case registered for the offences punishable under Sections 20, 22, 23 and 24 of the NDPS Act.

Prosecution case is that 90 gms of smack was recovered from the possession of the petitioner and considering the quantity of recovery, the earlier prayer for bail of the petitioner was rejected vide order dated 15.01.2015 passed in Cr. Misc. No. 25311 of 2014.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.33576 of 2016 (6) dt.29-11-2017 2/2 petitioner that the petitioner is languishing in custody since 25.07.2012, though all the witnesses have been examined. Since the petitioner is languishing in custody since more than five years it is high time that the learned 3rd Additional Sessions Judge, East Champaran at Motihari should conclude the trial of NDPS Case No. 81 of 2012, arising out of Adapur (Nakardei) P.S. Case No. 86 of 2012 within a period of three months.

Considering the present stage of trial and the fact that all the witnesses have been examined, this Court is not inclined to revise the earlier order. Accordingly, this application is disposed of.
