The matter has been taken up through video conferencing.

The petitioner seeks bail in Chautham P.S. case No. 272/2019 registered u/s 395 of the IPC.

The informant lodged the case against unknown for looting his TVS Victor motor cycle bearing registration No. BR34K- 4960, one Samsung mobile with SIM Jio No. 8709002971 and another SIM No. 7352609933. Another mobile of brother of informant, Ajit Kumar, with SIM No. 7644996994 was also looted.

The learned counsel for the petitioner submits that petitioner is innocent and, in fact, he has committed no offence. The petitioner is in custody since 15.01.2020. Redmi mobile

Patna High Court CR. MISC. No.25844 of 2020(3) dt.23-11-2020 2/2 was recovered from the possession of the petitioner and the same was not looted one but from perusal of the case diary it appears that petitioner was apprehended and from his possession looted SIM was recovered. The petitioner also confessed his guilt.

Taking into consideration the facts aforesaid and the fact that it is a case of road dacoity, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
