JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 12.03.2022, charge-sheet has been submitted in the case and has antecedent of two cases. Allegation is of recovery of 87.360 litres of liquor from bags loaded on motorcycle.

Learned counsel for the petitioner submits that the petitioner had parked his motorcycle when it appears that someone on seeing the police kept the bag on the motorcycle and the petitioner came to be implicated when search was made.

Patna High Court CR. MISC. No.24630 of 2022(2) dt.20-05-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 12.03.2022 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Brahmpur (Nainijor) P.S. Case No. 39 of 2022.
