JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Saharsa RPF Case No. 4 of 2018 for the offenses under Sections 3 RP (UP) Act.

Allegation against the petitioner is that he was involved in theft of cables wire of the Railway. Learned counsel for the petitioner submits co-accused Md. Firoz was apprehended with stolen railway property. It is alleged that he used to sale the stolen cable wire to Jagdish Sah from whose shop 8 meters of cable wire was seized. It is alleged that this petitioner has purchased some burnt wire from Jagdish Sah and the cable was recovered from the scrap shop of this petitioner. The petitioner is in custody since 9.1.2019.
