The petitioner is in custody in connection with Fulwariya P.S. Case No. 42 of 2018 for the offence under Sections 380, 457, 411/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that allegation against this petitioner is that he was involved in theft. Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner to show his involvement in the instant case. He submits that petitioner is in custody since 21.08.2018.

Considering the fact that petitioner has remained in custody for more than seven months, the Court is inclined to
