JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-10-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Jamui, Sono P.S. Case No. 258 of 2019 registered for the offence under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, three unidentified miscreants, having covered their faces, pushed the motorcycle of the informant and snatched his bag, containing cash of Rs. 9,30,000/- (Rupees nine lacs & thirty thousand). It is further alleged that when informant tried to chase them, all the accused persons after firing in air fled away.

It is submitted on behalf of petitioner that petitioner has been named in this case on the basis of confessional

Patna High Court CR. MISC. No.24588 of 2020(2) dt.07-10-2020 2/2 statement of co-accused Chandan Barnwal. No incriminating article has been recovered from the conscious possession of the petitioner. It is stated in paragraph - 3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui, in connection with Sono P.S. Case No. 258 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
